CMSD staff responsible for recommending action to the EDC will continue to assess the appropriateness of the proposed action in the light of new information or representations they receive and any material change in the facts or circumstances relating to a particular matter. It may be therefore that CMSD may decide to advise the EDC to consider whether or not to give a notice of discontinuance to a person to whom a warning notice or enforcement order has been given.
