If representations are made, the EDC will consider whether it is right in all the circumstances to give an enforcement order, then the EDC will:

(a) Review the material before it;
(b) Consider any representations made (whether written, oral or both) and any comments by CMSD staff or others in respect of those representations;
(c) Decide whether to give the notice, and the terms of any notice given.
